Protect Elections from Deceptive AI Act
Protect Elections from Deceptive AI Act
Plain Language Summary
# Protect Elections from Deceptive AI Act (S 1213) Summary **What the Bill Would Do** This bill would make it illegal to distribute fake AI-generated videos or audio recordings that mislead people about federal candidates during elections. The law would prohibit anyone—including individuals, political groups, and organizations—from knowingly spreading these deceptive materials if the goal is to influence an election or raise money. For example, someone could not create a fake video of a candidate saying something they never said and share it to sway voters. The bill includes narrow exceptions for news organizations that broadcast such material with clear disclaimers as part of legitimate reporting. **Who It Affects and Key Provisions** The bill would affect candidates, political campaigns, social media users, and anyone involved in election activities.
It gives federal candidates a legal remedy if their voice or face is used in deceptive AI media—they could sue to stop the spread of the material and seek damages. However, the law only applies to material that is "materially deceptive," meaning it could realistically fool people, not clearly satirical or labeled content. **Current Status** The bill is currently in committee and has not yet been voted on by the full Senate. It was introduced by Senator Amy Klobuchar (D-Minnesota) in the 119th Congress.
